Federal Magistrate Considers Arguments in Lawsuit Over Access to Executions by Idaho News Groups


Three news organizations have filed a lawsuit against Idaho prison officials, claiming that the officials are hiding parts of lethal injection executions from public view. The Associated Press, EastIdahoNews.com, and The Idaho Statesman are asking to temporarily stop the state from restricting media witnesses from viewing the actual injection of lethal chemicals in any upcoming executions. The lawsuit argues that media witnesses play a crucial role in the public’s understanding of executions and that the public has a historical right of access to such proceedings.

Idaho currently allows media witnesses to view the first and third steps of lethal injection executions but prohibits them from seeing the second step, where the lethal drugs are drawn into syringes and administered to the condemned person. The state contends that this step is a “minute detail” that does not need to be witnessed by the public and that keeping the medication team room hidden helps protect team members from harassment or threats. The attorney representing the news organizations argued that this step is inextricably intertwined with the process of putting someone to death.

The federal magistrate judge overseeing the case seemed skeptical of the state’s arguments and has not yet issued a ruling on the preliminary injunction request. Idaho has a history of contentious executions, with the most recent attempt being aborted last year after repeated failed attempts to establish an IV line. Lawmakers passed a new law making firing squads the state’s primary method of execution starting next year. The case highlights the ongoing debate over transparency and public access to executions in the United States.
