Texas Hospital That Discharged Woman with Risky Pregnancy Violated Laws, Investigation Reveals


A recent federal investigation found that Ascension Seton Williamson hospital in Texas violated the law by repeatedly sending Kyleigh Thurman home without addressing her life-threatening ectopic pregnancy, ultimately leading to the loss of part of her reproductive system. Thurman, 36, was discharged despite clear signs of her condition, resulting in severe hemorrhaging days later and an emergency surgery.

This investigation marked a significant, albeit small, victory for Thurman and highlighted the troubling trend of hospitals denying emergency abortions amid escalating abortion restrictions in several states post the Supreme Court’s 2022 ruling. The Biden administration had previously directed hospitals to provide emergency abortions in extreme medical situations, under the Emergency Medical Treatment and Labor Act (EMTALA), warning that non-compliance could risk their federal funding. However, the Centers for Medicare and Medicaid Services (CMS) announced its intention to revoke this guidance, raising concerns about the protection of women’s rights to necessary medical care.

Despite this, CMS stated it would still enforce laws concerning medical emergencies. Experts have warned that strict abortion laws deter hospital staff from offering necessary interventions, even in critical scenarios, as evidenced by Thurman’s ordeal. In Texas, doctors could face severe penalties for performing illegal abortions, leading to hesitancy in managing nonviable pregnancies.

Thurman expressed hope that the investigation would clarify the need for hospitals to treat ectopic pregnancies decisively. However, she remains concerned about future patients facing similar complications, emphasizing that unforeseen pregnancy complications can occur, potentially jeopardizing women’s lives in states with stringent abortion laws.
